The big winner in Obama’s jobs package will be none other than the trial lawyers. There is a provision in the President’s “must-pass” jobs bill that I guarantee will create some jobs…in the trial lawyer business! The provision in the bill would make it illegal for any business to discriminate against the already unemployed. Leave it to politicians to create another victim class right out of thin air.

“President Obama’s American Jobs Act, which he presented to Congress, would make it illegal for employers to run advertisements saying that they will not consider unemployed workers, or refuse to consider or hire people because they are unemployed.”
“The proposed language is found in a section of the bill titles Prohibition of Discrimination in Employment on the Basis of an Individual’s Status as Unemployed. That section would also make it illegal for employers to request that employment agencies take into account a person’s unemployed status.”
“It would also allow aggrieved job seekers to seek damages if they have been discriminated against.”
Just what every employer wants! The threat, that someone they decided not to hire, will turn around and hire a lawyer and sue them under the notion that they did not get the position because of “unemployment discrimination.” Did Al Sharpton or Jesse Jackson come up with this? With 14 million unemployed that is a big target market for the 1-800-SUE crowd.
I have a few questions…
Is it unfair to judge a job candidate based upon his or her employment history?
If a job involves a specialized skill set that evolves over time would not a long-term unemployed person by default be less qualified for the position?
Could be me, call me crazy, but doesn’t this bill place a huge target on the backs of large deep pocketed companies for discrimination lawsuits; and deter small-firms from even bothering to hire?
Last but not least, is there anyone within this administration that looks at the repercussions of their legislative actions at all?
